By accessing and using the Adinav Elegance website ("Site") at adinavelegance.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, please do not use the Site.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on the Site. Your continued use of the Site constitutes acceptance of any modified Terms.

2. Products and Services

Adinav Elegance offers the following products:

  • Physical Prints: Museum-quality giclee prints on premium papers, produced and shipped by our fulfillment partner Gelato
  • Digital Downloads: High-resolution digital art files for personal use

All product images on our Site are for illustration purposes. While we strive for accurate representation, actual colors may vary slightly due to monitor settings and printing processes.

3. Pricing and Payment

Pricing

  • All prices are displayed in Euros (EUR) and include applicable VAT where required
  • Shipping costs are calculated at checkout based on your location
  • We reserve the right to change prices at any time without prior notice
  • Price changes do not affect orders already confirmed

Payment

  • We accept payment via Stripe (credit/debit cards)
  • Payment is processed securely at the time of purchase
  • Your financial information is never stored on our servers
  • Orders are confirmed only after successful payment

4. Shipping and Delivery

Physical Products

  • Production Time: 2-5 business days for print production
  • Shipping Time: Varies by location (typically 5-15 business days)
  • Shipping Partners: Products are shipped by Gelato through various carriers
  • Tracking: Tracking information is provided via email once shipped

Digital Downloads

  • Available immediately after purchase confirmation
  • Download links are sent via email
  • Links remain active for a limited time

Delivery times are estimates and may vary due to factors beyond our control. We are not responsible for delays caused by customs, local postal services, or force majeure events.

5. Returns and Refunds

Physical Products

As our products are made-to-order, we generally do not accept returns. However, we will provide a replacement or refund if:

  • The product arrives damaged
  • The product has a significant printing defect
  • You received the wrong item

To request a return or refund, contact us within 14 days of delivery with photos of the issue. We will assess each case individually.

Digital Downloads

Due to the nature of digital products, all sales of digital downloads are final. Refunds are not available once the download link has been accessed.

Exceptions may be made if there are technical issues preventing download that we cannot resolve.

6. Digital Downloads - License Terms

When you purchase a digital download, you receive a limited, non-exclusive license:

Permitted Uses

  • Print for personal, non-commercial use
  • Display in your home or office
  • Create one backup copy for personal archival

Prohibited Uses

  • Resale or redistribution of the digital file
  • Commercial use without written permission
  • Modification or creation of derivative works
  • Sharing or transferring to third parties
  • Use in print-on-demand services

Violation of these license terms may result in legal action and termination of your license rights.

7. Intellectual Property

All content on this Site, including but not limited to images, artwork, text, logos, and designs, is the intellectual property of Adinav Elegance or its licensors and is protected by copyright and other intellectual property laws.

  • You may not copy, reproduce, or distribute our content without permission
  • Purchasing a product does not transfer copyright or intellectual property rights
  • Unauthorized use may result in legal action

8. User Conduct

When using our Site, you agree not to:

  • Use the Site for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the Site
  • Submit false or misleading information
  • Use automated systems to access the Site without permission

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved in the courts of France. EU consumers may also use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
